Service Terms & Conditions
Fees:
The cost of a 60 minute session is $180, which is payable three (3) days in advance of the session via the Splose portal. An invoice will be sent to you the seven (7) days prior to your session and you can then login and pay for the session.
Cancellation Policy:
If, for some reason you need to cancel or postpone the appointment you have made, please give me at least 24 hours notice, otherwise you will be charged for the session. A copy of your credit card is kept on file in case of an unpaid cancellation fee.
Cancellation of session fees are: Less than 24 hours notice you will be charged the full session fee of $180. Between 24 and 48 hours notice you will be charged half the session fee of $90.
In the rare instance that the Facilitator (Joelene Mitchell) needs to cancel or reschedule a booking, the booking will either be rescheduled at no additional cost, or if the client requests, can be 100% refunded.
By signing this consent form you are signing an agreement to abide by this cancellation policy.
Healing Disclaimer:
The following disclaimer is provided for your information and for legal reasons in accordance with the current Australian Legislation.
You (the client) understand that Energy Healing/Spiritual Healing/Energy Clearing is a simple, gentle technique that is used to promote stress reduction and relaxation. You (client) acknowledge that Healing practitioners do not diagnose conditions nor do they prescribe or perform medical treatment, nor interfere with the treatment of a licensed medical professional. You (client) understand that Energy Energy Healing/Spiritual Healing/Energy Clearing does not take the place of medical advice and/or treatment. It is further advised that you (client) consult a licensed medical doctor for any physical or psychological ailment you may have. You (client) understand that the body has the ability to heal itself and to do so; relaxation and stress reduction are often beneficial. You client) acknowledge that long term imbalances in the body often require multiple sessions in order to facilitate and restore balance within the body. You (client) understand that any discomfort, pain or reaction to this session is part of the body’s response and not caused by the practitioner (Joelene Mitchell) facilitating the treatment. You (client) hereby accept that there shall be no liability on the practitioner should adverse effects be experienced.
Termination of Service
Joelene Mitchell retains the right to leave the Energy Healing/Spiritual Healing/Energy Clearing session at any time if I am made to feel uncomfortable and clients will have this same right.
Joelene Mitchell has the right to terminate the session/consultation should the connection not feel strong enough. The client also has the right to terminate the session in the first 10 minutes without being charged should the session not be appropriate for them.
Online Zoom Appointments
You will be provided with a Zoom meeting address at the time of finalising your booking and you will be required to connect via Zoom at the date and time chosen by you when you made your booking.
Should contact not be made successfully within the first 15 minutes of your scheduled time, it will be treated as a missed appointment in accordance with our Cancellation Policy set out below.
Australian Consumer Law
Certain legislation, including the ACL in the Consumer and Competition Act 2010 (Cth), and similar consumer protection laws and regulations may confer you with rights, warranties, guarantees and remedies relating to the provision of services by us to you which cannot be excluded, restricted or modified (Statutory Rights). Nothing in the Terms limits or excludes any guarantees, warranties, representations or conditions implied or imposed by law, including the ACL or any liability under the ACL, which by law may not be limited or excluded.
We exclude all implied conditions and warranties except for your Statutory Rights, to the extent permitted by law, including but not limited to:
we expressly disclaim any implied or express guarantees, warranties, representations or conditions of any kind, which are not stated in these Terms;
we do not warrant that the Site or your access to the Site will be error free, that any defects will be corrected or that the Site or the server which stores and transmits material to you are free of viruses or any other harmful components;
we take no responsibility for, and will not be liable for, the Site or any of our products and/or services being unavailable; and
we will not be liable for any loss, damage, costs including legal costs, or expense whether direct, indirect, incidental, special, consequential and/or incidental, including loss of profits, revenue, production, opportunity, access to markets, goodwill, reputation, use or any indirect, remote, abnormal or unforeseeable loss, or any loss or damage relating to business interruption, loss of programs or other data on your information systems or costs of replacement goods, or otherwise, suffered by you or claims made against you, arising out of or in connection with the Site, inability to access or use the Site, the products, the services, the late supply of products, or the Terms, even if we were expressly advised of the likelihood of such loss or damage.
Privacy Policy
As part of providing a support service to you I, Joelene Mitchell, will need to collect and record personal information from you that is relevant to your current situation. This information will be a necessary part of the assessment and treatment that is conducted.
Mental Health:
The Client must inform myself of events of psychosis, suicidal idolisations, suicidal events or other serious mental health conditions prior to the next appointment. To ensure client safety, I (Joelene Mitchell) reserves the right to pause or terminate future sessions until the client has sought appropriate treatment from the relevant health care professionals.
Access:
You may access the material recorded upon your file upon request, subject to the exception in National Privacy Principle.
For Practicum Clients Only: Sessions may be recorded for the exclusive use of Joelene Mitchell as a reflective learning tool. All recordings will be stored securely and will be deleted at the end of the Practicum. No other person will have access to the recordings.
Confidentiality:
All personal information gathered by the counsellor during the provision of the counselling service will remain confidential and secure except when:
1. It is subpoena by a court, or
2. Failure to disclose the information would place you and/or another person at risk, or
3. Your approval has been obtained to:
a) Provide a written report to another agency or professional, e.g. a GP or lawyer, or
b) To discuss the material with another person, e.g. a parent or employer.
